The purpose of this course is to make you informed consumers of research and over the semester you have gained knowledge of the components of research that will assist you in this final assignment. The research critique consists of reading three research studies and answering several questions about each. All three studies have been provided for you. The studies selected for the critique are as follows:

 

Article 1:
Guerette, Rob T. (2007). “Immigration Policy, Border Security and Migrant Deaths: An Impact Evaluation of Life Saving Efforts under the Border Safety Initiative.” Criminology & Public Policy, 6(2): 201-222.

Article 2:
Kovandzic, T., Sloan, J., and Vieraitis, L. (2004. “’Striking Out’ as Crime Reduction Policy: The Impact of ‘Three Strikes’ Laws on Crime Rates in U.S. Cities.” Justice Quarterly, 21(2): 207-239.

Article 3:
D’Alessio, S; Stolzenberg, L., and Terry, W. Clinton III (1999). “Eyes on the Street”: The Impact of Tennessee’s Emergency Cellular Telephone Program on Alcohol-related Fatal Crashes.” Crime and Delinquency, 45(4): 453- 466.

 

For each of these research articles perform the following:
1. Identify the research design used.

2. Specify the type of data used to conduct the analysis.

3. Identify the sampling procedure employed.

4. Specify the dependent variable of the study.

5. Present the key findings of the study.

6. Identify at least 3 limitations of the study (e.g. threats to validity, reliability, etc.) and explain each.

Provide separate answer sheets for each article and identify your responses to the specific question above that you are answering. Your responses should be typed, 12 point font, and single spaced. Your answers are due on the last day of the week that the final exam is scheduled). Be sure to explain each of your answers fully. You should strive to be as comprehensive in your answers as possible as if you were explaining your answers to a lay person who knows nothing about research methodology.

Maynard, 18, was shopping for his first car. With a mere $4,000, he was hoping for a deal. He found a used convertible 1979 Mustang at Pierre’s Awesome Car Place for $5,000. Pierre claimed that the Mustang was “one of a kind” and “the best car in town.” He said the “engine and brakes are in tip-top shape.” Pierre even promised to bring the price down to $4,000, if Maynard agreed to buy it that very day.

Maynard immediately signed an agreement that contained an “as-is” clause and drove off in the car. Two days later, the brakes failed while driving and Maynard crashed into a tree. The front of the car was damaged and Maynard sustained mild injuries. Infuriated, Maynard immediately towed the vehicle back to Pierre’s and confronted him. Pierre shrugged it off, saying, “Too bad. Bad brakes or not, you agreed to the “as-is” clause in the contract!”

Now Maynard does not know what to do. He has lost two weeks of work pay due to the injury, a damaged car that cost him $4,000, and physical pain and mental trauma. To make things worse, Maynard discovered the car’s fair market value was actually only $1,500 at the time of the purchase.
Research contract concepts related to formation and defenses to enforcement using your textbook, the Argosy University online library resources, and the Internet. Based on the facts of the case and your research, respond to the following questions:

  • Was a valid contract formed between Pierre’s and Maynard? Explain.
  • If a valid contract was formed, does Maynard have any arguments to have his money refunded?
  • What are Maynard’s rights under the Uniform Commercial Code (UCC) with respect to the “as-is” agreement he signed?
  • What damages, if any, can Maynard sue Pierre’s for?
  • Discuss any ethical issues concerning Pierre’s behavior.

  • Do George and Mary have a case? What are their strongest legal arguments? Explain.
  • What defense(s), if any, do the school and the restaurant have? Explain.
  • Can the government agencies, such as the Federal Trade Commission (FTC) help the plaintiffs in any way? Explain.

You have been hired as a management consultant by a large company to examine the company’s business decisions regarding employee protections. In response to the three questions below, write a 4–6 page paper in which you do the following:

  1. Analyze, identify, and explain recent legislation, within the last 10 years, that helps to protect employees from discrimination in the workplace. Provide at least two federal legislative protections. Provide some insight when the federal legislation conflicts with the state.  
  2. Explain the EAW doctrine and all exceptions to the doctrine. Look at the scenarios below and determine whether the decision to fire the employee is a smart one. Identify why or why not, and determine all the possible exceptions per the EAW doctrine that are, might be, or could be applicable if the employee sues for wrongful termination.      
    • Brenda, a manager, started a blog on the company website for employee grievances. She noticed that a worker was protesting that no Asian American employees had gotten a raise in two years at the company. The worker also criticized how much the CEO made and how the CEO was “out of touch.” Brenda reprimanded the worker. The next day, the worker talked to fellow co-workers about forming a union. Brenda subsequently fired the worker.
    • Jason, a department supervisor, requests approval to fire his secretary, Alice. Alice, a devout Christian, has been putting Right-to-Life flyers in the employee breakroom. Alice is also taking time out to pray each day during the busiest time of the morning.
    • Brian, the head of the accounting department, refused to sign Lori’s leave request for jury duty. Lori is a tax attorney in his department. Brian wants to fire Lori for being absent without permission during their busiest time—tax season.
    • Peter has worked for the company for one year. He has a rare form of liver disease and works with chemicals that make his condition worse. Peter does not want to stop working, but his boss is not happy with his performance and wants to let him go.
  3. Determine the federal law regarding undocumented workers and whether they are eligible for state workers’ compensation in the United States. Advocate for or against this practice and substantiate your response with research to support your position.

Occupy movement | Law homework help

What happened to the occupy movement? Did it make a difference, was all the damage and trouble wort it? More importantly, did many of the acts of violence and criminal damage qualify as domestic terrorism?

I have been watching the occupy movement and have wondered what if any internal threats to our society are introduced through these “movements.” I concur there is a large amount of civil unfairness and there is reason for concern (in my opinion) that our values are not reflected in industry and society and even government. But then I see these “Occupy” people. I don’t think they reflect me either. What appears to be their goal Utopian-socialist society which cannot be achieved in my opinion. Far from any scientific research it looks like the same group of malcontents that protest about anything and many of which have little to no higher education and or professional skills. I am certain there are highly educated individuals in this movement, however I am concerned with the the people who are actually living in the tents and are “occupying” something.

My point is this, these groups are particularly susceptible to influence that can threaten society. Would Tim McVeigh be at Occupy Phoenix (with all eight of of the other Occupiers)? Would Eric Rudolph be at Occupy Memphis?

What are your thoughts, are a majority of “Occupy” people just slackers wandering from protests to protests ripe for nefarious influence? or are they something different?
